Enforcement Decree of the Act on the Protection of and Support for Small Business Owners, Article 4-9 (Composition and Operation of Compensation Review Committee for Losses)

① 법 제12조의4제1항에 따른 손실보상 심의위원회(이하 "보상심의위원회"라 한다)의 같은 조 제3항제1호 및 제2호에 따른 위원(이하 "위촉직위원"이라 한다)은 다음 각 호에 해당하는 사람 중에서 성별을 고려하여 중소벤처기업부장관이 위촉한다.

5. 그 밖에 손실보상, 방역 또는 소상공인 관련 분야에 대한 학식과 경험이 풍부하다고 중소벤처기업부장관이 인정하는 사람

② 위촉직위원의 임기는 2년으로 하며, 한 차례만 연임할 수 있다.

③ 법 제12조의4제3항제3호에 따른 위원(이하 "당연직위원"이라 한다)은 다음 각 호의 중앙행정기관 소속의 고위공무원단에 속하는 일반직공무원 중에서 해당 기관의 장이 지명하는 사람으로 한다. <개정 2025.12.30>

④ 보상심의위원회 위원장은 필요하다고 인정하거나 재적위원 과반수의 요구가 있을 때에 보상심의위원회의 회의를 소집한다.

(4) The^ð더 chairperson체어퍼슨 of어^v브 the^ð더 Compensation캄펀세이션 Review^r리^v뷰 Committee커미티 shall섈 convene컨^v빈 meetings미팅즈 of어^v브 the^ð더 Compensation캄펀세이션 Review^r리^v뷰 Committee커미티 where웨어 the^ð더 chairperson체어퍼슨 deems딤즈 it잇 necessary네서세^r리 or오 where웨어 a어 majority머조^r러티 of어^v브 the^ð디 incumbent인컴번트 members멤버즈 so소우 request.^r리퀘스트

⑤ 보상심의위원회 위원장은 제4항에 따라 소집된 회의의 의장이 된다.

⑥ 보상심의위원회 위원장이 부득이한 사유로 직무를 수행할 수 없을 경우에는 위원장이 미리 지명한 위원이 그 직무를 대행한다.

⑦ 보상심의위원회의 회의는 재적위원 과반수의 출석으로 개의(開議)하고, 출석위원 과반수의 찬성으로 의결한다.

⑧ 보상심의위원회의 회의는 위원이 직접 출석하는 회의(화상회의를 포함한다. 이하 이 조에서 같다)로 개최한다. 다만, 다음 각 호에 해당하는 경우에는 서면회의로 개최할 수 있다.

⑨ 보상심의위원회는 법 제12조의4제4항 및 이 영 제4조의6에 따른 심의를 위하여 필요한 경우 관계자 등의 의견을 청취할 수 있다.

⑪ 제1항부터 제10항까지에서 규정한 사항 외에 보상심의위원회의 구성ㆍ운영 및 법 제12조의4제6항에 따른 실무위원회의 구성ㆍ운영 등에 필요한 사항은 보상심의위원회의 의결을 거쳐 보상심의위원회 위원장이 정한다.
