소상공인 보호 및 지원에 관한 법률 시행령 제2조(사업승계 시 동일성 유지 요건)

소상공인으로부터 영업상의 권리ㆍ의무를 포괄적으로 이전받은 자가 영업상의 권리ㆍ의무를 포괄적으로 이전받은 업종[「통계법」 제22조제1항에 따라 국가데이터처장이 작성ㆍ고시하는 산업에 관한 표준분류(이하 "한국표준산업분류"라 한다)에 따른 세분류상의 업종을 말한다]과 같은 업종을 영위하는 경우에는 법 제2조제3호에 따라 동일성을 유지하는 것으로 본다. 이 경우 이전받은 업종에 다른 업종을 추가하여 영업을 영위하는 경우에는 추가된 업종의 매출액이 총매출액의 100분의 50 미만이면 같은 업종을 영위하는 것으로 본다. <개정 2025.10.1>
