소방공무원 복무규정 제9조의2(복무점검 등)

① 소방기관의 장은 근무기강을 확립하기 위하여 소속 소방공무원의 복무를 점검하고, 의무 위반행위의 조사ㆍ방지 등의 조치를 해야 한다.

② 소방청장은 소방기관(소방청은 제외한다. 이하 이 조에서 같다)에 대하여 제1항에 따른 복무점검 또는 조치의 적정성을 확인하기 위해 필요한 자료의 제출을 요구할 수 있다. 다만, 소방청장은 필요하다고 인정되는 경우에는 직접 복무점검을 하거나 의무 위반행위를 조사할 수 있다.

③ 소방청장은 제2항 단서에 따라 복무점검을 하거나 의무 위반행위를 조사한 경우에는 그 결과를 해당 소방기관의 장에게 통보해야 한다.

④ 소방청장은 제2항 본문에 따라 제출받은 자료를 검토한 결과 또는 같은 항 단서에 따른 복무점검이나 의무 위반행위를 조사한 결과, 시정ㆍ보완 등이 필요하다고 인정되는 경우에는 그 시정 또는 보완 등 필요한 조치를 요구할 수 있다.

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 소방공무원에 대한 복무점검 및 의무 위반행위의 조사ㆍ방지 등에 필요한 사항은 소방청장이 정한다.
