소금산업 진흥법 시행령 제15조(권한의 위임)
Enforcement Decree of the Salt Industry Promotion Act, Article 15 (Delegation of Authority)
① 해양수산부장관은 법 제58조제1항에 따라 다음 각 호의 권한을 시ㆍ도지사에게 위임한다. <개정 2013.3.23, 2015.5.1, 2022.4.27>
(1) Pursuant to Article 58 (1) of the Act, the Minister of Oceans and Fisheries shall delegate the following authority to Mayors/Do Governors:
1. 법 제27조에 따른 비식용소금 제조업 등의 신고의 수리
1. Acceptance of reports on non-edible salt manufacturing business, etc. under Article 27 of the Act;
1의2. 법 제31조제2항에 따른 식용천일염생산해역 및 주변해역에서의 동물용 의약품 사용행위의 제한 또는 금지
1-2. Restriction or prohibition of the use of veterinary drugs in edible solar salt production sea areas and surrounding sea areas under Article 31 (2) of the Act;
2. 법 제49조의2에 따른 근로강요행위 금지 위반자에 대하여 지원한 자금의 환수
2. Recovery of funds provided to persons who violate the prohibition of forced labor under Article 49-2 of the Act;
3. 법 제55조에 따른 포상금의 지급
3. Payment of rewards under Article 55 of the Act.
② 시ㆍ도지사는 법 제58조제1항에 따라 다음 각 호의 권한을 시장ㆍ군수 또는 자치구의 구청장에게 위임한다. <개정 2019.6.4, 2022.4.5, 2022.4.27>
(2) Pursuant to Article 58 (1) of the Act, a Mayor/Do Governor shall delegate the following authority to the head of a Si/Gun or autonomous Gu:
1. 법 제23조에 따른 소금제조업 등의 허가 및 증명서류의 발급
1. Permits for the salt manufacturing business, etc. and issuance of supporting documents under Article 23 of the Act;
2. 법 제25조제4항에 따른 지위승계 신고의 수리
2. Acceptance of reports of succession to status under Article 25 (4) of the Act;
3. 법 제26조에 따른 허가취소 및 영업정지명령
3. Revocation of permits and orders to suspend business under Article 26 of the Act;
4. 법 제27조의2제1항에 따른 소금제조업 등의 폐전신고ㆍ폐업신고의 접수
4. Receipt of reports of closure of salt fields and closure of the salt manufacturing business, etc. under Article 27-2 (1) of the Act;
5. 법 제57조제1호에 따른 청문
5. Hearings under Article 57 1 of the Act.
③ 해양수산부장관은 법 제58조제1항에 따라 다음 각 호의 권한을 국립수산물품질관리원장에게 위임한다. <개정 2019.6.4, 2013.3.23, 2022.4.27, 2023.2.24>
(3) Pursuant to Article 58 (1) of the Act, the Minister of Oceans and Fisheries shall delegate the following authority to the Commissioner of the National Fishery Products Quality Management Service:
1. 법 제35조제1항에 따른 품질검사
1. Quality inspection under Article 35 (1) of the Act;
2. 법 제39조에 따른 우수천일염에 대한 인증, 교육훈련, 기술ㆍ정보 제공, 우수천일염생산기준의 고시
2. Certification of excellent solar salt, education and training, provision of technology and information, and public notice of excellent solar salt production standards under Article 39 of the Act;
3. 법 제42조에 따른 천일염인증의 갱신 및 유효기간 연장 승인
3. Renewal of solar salt certification and approval of extension of validity period under Article 42 of the Act;
4. 법 제45조제1항에 따른 천일염인증의 사후관리
4. Post-management of solar salt certification under Article 45 (1) of the Act;
5. 법 제46조에 따른 천일염인증품에 대한 시정명령, 판매금지 또는 표시정지
5. Corrective orders, sales prohibition, or suspension of labeling for certified solar salt products under Article 46 of the Act;
6. 법 제47조제1항에 따른 천일염인증의 취소
6. Revocation of solar salt certification under Article 47 (1) of the Act;
7. 법 제48조제2항 및 제3항에 따른 천일염인증 지위 승계 신고의 수리 및 신고 수리 여부의 통지
7. Acceptance of reports of succession to solar salt certification status and notification of whether reports are accepted under Article 48 (2) and (3) of the Act;
8. 법 제53조에 따른 보고 또는 자료제출 요구, 출입ㆍ조사ㆍ점검ㆍ검사ㆍ수거(국립수산물품질관리원장에게 위임된 권한에 관한 사항으로 한정한다)
8. Requests for reports or submission of data, and entry, investigation, inspection, examination, and collection under Article 53 of the Act (limited to matters concerning authority delegated to the Commissioner of the National Fishery Products Quality Management Service);
9. 법 제54조에 따른 명예감시원의 위촉ㆍ운영 및 경비 지급
9. Commissioning and operation of honorary inspectors and payment of expenses under Article 54 of the Act;
10. 법 제57조제5호 및 제6호에 따른 청문
10. Hearings under Article 57 5 and 6 of the Act;
11. 법 제66조제1항제2호 및 제3호에 따른 과태료의 부과ㆍ징수(국립수산물품질관리원장에게 위임된 권한에 관한 사항으로 한정한다)
11. Imposition and collection of administrative fines under Article 66 (1) 2 and 3 of the Act (limited to matters concerning authority delegated to the Commissioner of the National Fishery Products Quality Management Service).
④ 국립수산물품질관리원장은 해양수산부장관의 승인을 받아 제3항에 따라 위임받은 권한의 일부를 소속 기관의 장에게 재위임할 수 있다. 이 경우 국립수산물품질관리원장은 그 재위임한 내용을 고시해야 한다. <신설 2022.4.27>
(4) The Commissioner of the National Fishery Products Quality Management Service may, with the approval of the Minister of Oceans and Fisheries, re-delegate part of the authority delegated under paragraph (3) to the heads of agencies under his or her authority. In such cases, the Commissioner of the National Fishery Products Quality Management Service shall publicly notify the re-delegated content.
