선박평형수(船舶平衡水) 관리법 시행령 제7조(권한의 위임)
Article 7 (Delegation of Authority)
해양수산부장관은 법 제40조제1항에 따라 다음 각 호의 사항에 관한 권한을 지방해양수산청장(지방해양수산청장 소속 해양수산사무소의 장을 포함한다)에게 위임한다. <개정 2013.3.23, 2014.9.24, 2019.6.18>
The Minister of Oceans and Fisheries delegates authority regarding the following matters to the head of a Regional Office of Oceans and Fisheries (including the head of an Office of Oceans and Fisheries under a Regional Office of Oceans and Fisheries) under Article 40 (1) of the Act:
1. 법 제5조에 따른 입항 보고
1. Reports of port entry under Article 5 of the Act;
2. 법 제9조제1항에 따른 선박평형수관리계획서의 검인
2. Endorsement of the ballast water management plan under Article 9 (1) of the Act;
3. 법 제21조제1항에 따른 선박평형수처리업의 등록
3. Registration of a ballast water treatment business under Article 21 (1) of the Act;
4. 법 제23조제1항에 따른 선박평형수에 관한 처리실적서 수리
4. Acceptance of reports of ballast water treatment performance under Article 23 (1) of the Act;
5. 법 제24조에 따른 처리명령
5. Treatment orders under Article 24 of the Act;
6. 법 제25조제3항에 따른 선박평형수처리업자의 권리ㆍ의무 승계 신고의 수리
6. Acceptance of reports of succession to the rights and obligations of a ballast water treatment business operator under Article 25 (3) of the Act;
7. 법 제26조제1항에 따른 선박평형수처리업의 등록취소 및 업무정지 명령
7. Orders for revocation of registration and suspension of business of a ballast water treatment business under Article 26 (1) of the Act;
8. 법 제27조제1항 및 제2항에 따른 선박에 대한 조치명령 및 항해정지처분
8. Orders of measures against ships and dispositions of suspension of navigation under Article 27 (1) and (2) of the Act;
9. 법 제28조제1항에 따른 선박평형수관리를 위한 항만국통제
9. Port State control for ballast water management under Article 28 (1) of the Act;
10. 법 제32조제1항에 따른 재검사 및 재검정. 다만, 법 제34조에 따라 선박검사관이 수행하는 검사 및 검정에 대한 재검사 및 재검정은 제외한다.
10. Re-inspection and re-verification under Article 32 (1) of the Act. However, re-inspection and re-verification of inspections and verifications performed by ship inspectors under Article 34 of the Act are excluded;
11. 법 제33조제1항에 따른 보고ㆍ자료제출 명령
11. Orders to report or submit data under Article 33 (1) of the Act;
12. 법 제33조제2항에 따른 출입ㆍ조사
12. Entry and investigation under Article 33 (2) of the Act;
13. 법 제33조제3항에 따른 조사계획의 통보
13. Notification of investigation plans under Article 33 (3) of the Act;
14. 법 제33조제5항에 따른 항해정지명령 또는 수리ㆍ보완과 관련된 처분
14. Orders to suspend navigation or dispositions related to repair or supplementation under Article 33 (5) of the Act;
15. 법 제37조제3호에 따른 선박평형수처리업 등록취소를 위한 청문
15. Hearings for revocation of registration of a ballast water treatment business under Article 37 3 of the Act;
16. 법 제38조제1항제1호 및 같은 조 제4항에 따른 수수료의 징수
16. Collection of fees under Article 38 (1) 1 and (4) of the Act;
17. 법 제46조제1항에 따른 과태료의 부과ㆍ징수
17. Imposition and collection of administrative fines under Article 46 (1) of the Act.
