선거관리위원회법 제12조(위원의 대우)
Election Commission Act, Article 12 (Treatment of Members)
①각급선거관리위원회위원중 상임이 아닌 위원은 명예직으로 한다. 다만, 예산의 범위에서 다음 각 호의 비용을 지급할 수 있다. <개정 2024.1.30>
(1) Members of an election commission at any level who are not standing members are honorary officers. However, the following expenses may be paid within the budget:
1. 공명선거 등을 위한 자료 수집ㆍ연구, 추진 활동에 사용되는 비용을 보전하기 위하여 매월 지급하는 활동비. 이 경우 그 대상은 중앙선거관리위원회위원 중 상임이 아닌 위원으로 한정한다.
1. Monthly activity expenses to compensate for expenses used for collecting data, research, and promotion activities for clean elections, etc. In such cases, the recipients are limited to non-standing members of the National Election Commission;
2. 직무활동에 대하여 지급하는 수당
2. Allowances paid for performance of duties;
3. 여비 및 그 밖의 실비
3. Travel expenses and other actual expenses.
②중앙선거관리위원회의 상임위원은 정무직으로 하고 그 보수는 국무위원의 보수와 동액으로 하며, 시ㆍ도선거관리위원회의 상임위원은 1급인 일반직국가공무원으로서 「국가공무원법」 제26조의5에 따른 임기제공무원으로 한다. <개정 2002.1.19, 2016.1.15>
(2) The standing commissioner of the National Election Commission is a political appointee, with remuneration equal to that of a State Council member, and the standing commissioner of a Si/Do Election Commission is a general national public official of Grade 1 who is a fixed-term public official under Article 26-5 of the State Public Officials Act.
③각급선거관리위원회의 위원 및 위촉직원에 대한 활동비ㆍ수당ㆍ여비 및 그 밖의 실비에 관하여 이 법에서 정한 사항 외에는 중앙선거관리위원회규칙으로 정한다. <개정 2024.1.30>
(3) Matters concerning activity expenses, allowances, travel expenses, and other actual expenses of members of and commissioned staff of election commissions at each level, other than those prescribed in this Act, are prescribed by National Election Commission Rules.
