석탄산업법 제39조의4(폐광과 저당권)

① 채굴권자가 제39조의3제1항에 따른 소멸등록을 하려는 채굴권에 저당권이 설정되어 있을 때에는 미리 저당권자의 승낙을 받아야 한다.

② 산업통상부장관은 제39조의3제3항에 따라 취소된 채굴권에 저당권이 설정되어 있는 경우에는 지체 없이 그 취소 사실을 저당권자에게 통지하여야 한다. <개정 2013.3.23, 2016.1.27, 2025.10.1>

③ 제1항에 따른 승낙 또는 제2항에 따른 통지가 있는 경우에는 「광업법」 제36조 및 제37조를 적용하지 아니한다.
