석면피해구제법 제18조(미지급 요양급여등)

① 제9조에 따른 요양급여 및 제10조에 따른 요양생활수당(이하 "요양급여등"이라 한다)을 지급받을 권리가 있는 사람(이하 "수급권자"라 한다)이 사망한 경우 그 수급권자에게 아직 지급되지 아니한 요양급여등이 있으면 수급권자의 사망 당시 생계를 같이 하고 있던 유족의 청구에 따라 그 요양급여등을 지급한다. <개정 2020.5.26>

② 제1항에 따라 미지급 요양급여등을 지급받을 수 있는 사람의 순위는 그 배우자(사실상 혼인 관계에 있는 사람을 포함한다)ㆍ자녀ㆍ부모ㆍ손자녀ㆍ조부모 또는 형제자매의 순으로 한다. <개정 2020.5.26>

③ 제1항에 따라 미지급 요양급여등을 지급받을 수 있는 같은 순위의 유족이 2명 이상이면 그 유족에게 똑같이 나누어 지급한다.

④ 제1항에 따른 미지급 요양급여등의 지급 청구는 수급권자가 사망한 날부터 3년이 지났을 때에는 할 수 없다. <개정 2020.5.26>
