석면피해구제법 시행령 제26조(상시근로자 수의 산정방법 등)

① 법 제31조제2항제1호에 따른 상시근로자 수는 「고용보험 및 산업재해보상보험의 보험료징수 등에 관한 법률」에 따른 해당 보험연도의 전전년도의 상시근로자 수를 기준으로 산정한다. 다만, 해당 보험연도의 전전년도를 기준으로 상시근로자 수를 산정할 수 없는 경우에는 「고용보험 및 산업재해보상보험의 보험료징수 등에 관한 법률」 제7조에 따른 보험관계의 성립일 현재 사용하는 근로자의 수를 기준으로 한다.

② 법 제31조제3항에 따라 상시근로자 수를 산정하는 경우에는 해당 보험연도의 전전년도 매월 말일 현재 사용하는 근로자 수의 합을 전전년도의 조업월수로 나눈 수로 한다.
