생물다양성 보전 및 이용에 관한 법률 시행령 제15조(관련 자료의 제출)
Enforcement Decree of the Act on the Conservation and Use of Biological Diversity, Article 15 (Submission of Related Data)
기후에너지환경부장관이 법 제30조제1항에 따라 관련 자료를 제출하게 할 수 있는 경우는 다음 각 호와 같다. 이 경우 기후에너지환경부장관은 생물의 개체수 등 관련 자료를 정기적으로 제출하게 할 수 있다. <개정 2019.10.15, 2024.2.6, 2025.10.1>
The cases in which the Minister of Climate, Energy and Environment may require submission of related data pursuant to Article 30 (1) of the Act are as follows. In this case, the Minister of Climate, Energy and Environment may require periodic submission of related data such as the number of individuals of organisms:
1. 법 제30조제1항제1호에 해당하는 자가 국외반출 승인을 받아 사육 또는 보관하고 있는 생물자원이 안전 및 생존을 위협받을 우려가 있는 경우
1. Where the safety and survival of biological resources raised or kept by a person falling under Article 30 (1) 1 of the Act with export approval are likely to be threatened;
2. 다음 각 목의 생물이 생태계에 노출되었거나 노출될 가능성이 큰 경우
2. Where any of the following organisms has been exposed or is highly likely to be exposed to the ecosystem:
가. 법 제30조제1항제2호에 해당하는 자가 수입 또는 반입 승인을 받아 보관하고 있는 유입주의 생물
(a) Species requiring attention for introduction kept with import or introduction approval by a person falling under Article 30 (1) 2 of the Act;
나. 법 제30조제1항제3호에 해당하는 자가 수입ㆍ반입ㆍ사육ㆍ재배ㆍ양도ㆍ양수ㆍ보관ㆍ운반 또는 유통(이하 "수입등"이라 한다)의 허가를 받아 보관하고 있는 생태계교란 생물
(b) Ecosystem-disturbing species kept with permission for import, introduction, raising, cultivation, transfer, acquisition, storage, transportation, or distribution (hereinafter referred to as "import, etc.") by a person falling under Article 30 (1) 3 of the Act;
다. 법 제30조제1항제4호에 해당하는 자가 수입등의 허가 또는 승인을 받거나 신고ㆍ변경신고를 하여 보관하고 있는 생태계위해우려 생물
(c) Species of concern for ecosystem harm kept with permission or approval for import, etc. or with a report or change report by a person falling under Article 30 (1) 4 of the Act;
라. 법 제30조제1항제6호에 해당하는 자가 사육 또는 재배하는 생태계교란 생물
(d) Ecosystem-disturbing species raised or cultivated by a person falling under Article 30 (1) 6 of the Act;
2의2. 법 제30조제1항제5호에 해당하는 자가 방출, 방생, 유기 또는 이식(이하 "방출등"이라 한다)의 허가를 받은 생태계교란 생물 또는 생태계위해우려 생물에 대한 감시 또는 회수가 어렵다고 판단되는 경우
2-2. Where it is determined that it is difficult to monitor or recover ecosystem-disturbing species or species of concern for ecosystem harm for which a person falling under Article 30 (1) 5 of the Act has obtained permission for release, liberation, abandonment, or transplantation (hereinafter referred to as "release, etc.");
2의3. 법 제30조제1항제7호에 해당하는 자가 법 제22조제1항에 따른 승인을 받지 않고 유입주의 생물을 보관하고 있거나 보관하였던 경우
2-3. Where a person falling under Article 30 (1) 7 of the Act keeps or has kept species requiring attention for introduction without approval under Article 22 (1) of the Act;
2의4. 법 제30조제1항제8호에 해당하는 자가 법 제24조제1항 단서에 따른 허가 또는 승인을 받지 않고 생태계교란 생물을 보관하고 있거나 보관하였던 경우
2-4. Where a person falling under Article 30 (1) 8 of the Act keeps or has kept ecosystem-disturbing species without permission or approval under the proviso of Article 24 (1) of the Act;
2의5. 법 제30조제1항제9호에 해당하는 자가 법 제24조의2제1항부터 제4항까지에 따른 허가 또는 승인을 받지 않거나 신고ㆍ변경신고를 하지 않고 생태계위해우려 생물을 보관하고 있거나 보관하였던 경우
2-5. Where a person falling under Article 30 (1) 9 of the Act keeps or has kept species of concern for ecosystem harm without permission or approval or without reporting or filing a change report under Article 24-2 (1) through (4) of the Act;
3. 그 밖에 기후에너지환경부장관이 생태계의 위해 또는 교란 등을 방지하기 위하여 필요하다고 인정하는 경우
3. Other cases that the Minister of Climate, Energy and Environment deems necessary to prevent harm or disturbance to the ecosystem.
