새만금사업 추진 및 지원에 관한 특별법 제71조(「건축법」 및 「건축기본법」에 관한 특례)

① 새만금사업지역에서 「건축법」 및 「건축기본법」을 적용할 때에 같은 법의 규정에 따라 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장이 수행하는 사무는 새만금청장이 수행한다. <개정 2015.8.11, 2020.6.9>

② 새만금청장은 제1항에 따라 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장의 사무를 수행한 때에는 해당 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장에게 그 내용을 통보하여야 한다. <개정 2015.8.11>

③ 「건축법」의 규정에도 불구하고 제1항에 따라 새만금청장이 수행하는 사무는 새만금청에 두는 건축위원회에서 조사ㆍ심의한다. <개정 2015.8.11>

④ 제3항에 따른 건축위원회의 구성ㆍ운영 및 심의대상 등에 관하여 필요한 사항은 대통령령으로 정한다.

⑤ 건축법령 및 건축기본법령에 따라 해당 지방자치단체의 조례로 정하는 사항에 관하여 새만금청장은 새만금사업의 특성을 고려하여 전부 또는 일부에 대하여 따로 정하여 고시할 수 있다. 이 경우 새만금청장의 고시는 새만금사업지역에서 해당 지방자치단체의 조례로 본다. <개정 2015.8.11>

⑥ 「건축법」 제5조제1항, 제6조, 제8조, 제12조제1항, 제19조제3항 단서, 같은 조 제6항, 제20조제2항제3호, 같은 조 제3항ㆍ제4항, 제42조제1항 단서, 제43조제1항 각 호 외의 부분, 같은 조 제2항, 제59조제1항제2호, 같은 조 제2항, 제60조제1항 단서, 제61조제1항, 같은 조 제2항 각 호 외의 부분, 같은 조 제3항 각 호 외의 부분, 같은 항 제8호, 제69조제1항제1호나목, 같은 항 제2호나목ㆍ다목, 제70조제2호ㆍ제3호, 제71조제1항제4호 후단, 같은 항 제7호, 같은 조 제5항, 같은 조 제7항 후단 및 제72조제5항 전단에서 대통령령으로 정하도록 한 사항은 새만금청장이 새만금사업의 특성을 고려하여 대통령령으로 정하는 기준에 따라 따로 정하여 고시할 수 있다. <신설 2016.12.2>
