새만금사업 추진 및 지원에 관한 특별법 제22조(조성토지등의 공급)

Special Act on Promotion of and Support for the Saemangeum Project, Article 22 (Supply of Created Land, etc.)

① 사업시행자는 새만금사업으로 조성된 토지 또는 원형지(이하 "조성토지등"이라 한다)를 공급하려는 경우에는 조성토지등의 공급계획을 작성하여 새만금청장의 승인을 받아야 한다. 공급계획을 변경하려는 경우에도 또한 같다. <개정 2015.8.11>

② 사업시행자는 원형지를 공급받아 개발하려는 자(이하 "원형지개발자"라 한다)와 공급계약을 체결한 후 원형지개발자로부터 세부계획을 제출받아 이를 실시계획의 내용에 반영하여야 한다.

③ 새만금청장은 다음 각 호의 어느 하나에 해당하는 경우에는 원형지 공급 승인을 취소하거나 사업시행자로 하여금 그 이행의 촉구, 원상회복 또는 손해배상의 청구, 원형지 공급계약의 해제 등 필요한 조치를 취할 것을 요구할 수 있다. <개정 2015.8.11>

1. 사업시행자가 제1항에 따른 원형지의 공급계획대로 토지를 이용하지 아니하는 경우

④ 사업시행자는 다음 각 호의 어느 하나에 해당하는 경우 대통령령으로 정하는 바에 따라 원형지공급계약을 해제할 수 있다.

(4) In인 any에니 of어^v브 the^ð더 following^f팔로잉 cases,케이시즈 the^ð더 project프^r라젝트 implementer임플리먼터 may메이 terminate터머네잇 the^ð더 raw^r라 land랜드 supply서플라이 contract,칸트^r랙트 as애즈 prescribed프^r리스크^r라이브드 by바이 Presidential프^r레저덴실 Decree:디크^r리

1. 원형지개발자가 세부계획에서 정한 착수 기한 내에 공사에 착수하지 아니하는 경우

2. 원형지개발자가 공사 착수 후 세부계획에서 정한 사업기간을 넘겨 사업시행을 지연하는 경우

3. 공급받은 토지의 전부나 일부를 사업시행자의 동의 없이 제3자에게 매각하는 경우

⑤ 조성토지등의 공급계획의 내용, 공급의 절차와 기준 및 가격결정 방법, 원형지개발자의 선정기준, 사업시행자와 원형지개발자의 업무범위 및 계약방법, 그 밖에 필요한 사항은 대통령령으로 정한다.
