새마을금고법 시행령 제16조의5(금리인하 요구의 요건 및 절차)

① 법 제31조의2제1항에 따라 금고와 대출 등의 계약을 체결한 자가 금고에 금리인하를 요구할 수 있는 요건은 다음 각 호의 구분에 따른다.

② 금고는 법 제31조의2제1항에 따라 금리인하 요구를 받은 경우 신용상태의 개선이 금리 산정에 영향을 미치는지 여부 등 행정안전부장관이 정하여 고시하는 사항을 고려해 그 인하 여부를 결정할 수 있다.

③ 금고는 법 제31조의2제1항에 따라 금리인하의 요구를 받은 경우 그 요구를 받은 날부터 10영업일(자료 보완을 요구한 경우에는 그 요구한 날부터 자료가 제출된 날까지의 기간은 포함하지 않는다) 이내에 금리인하를 요구한 자에게 그 인하 여부 및 사유를 서면, 전화, 전자우편, 문자메시지, 팩스 또는 그 밖에 이와 유사한 방법으로 알려야 한다.

④ 제1항부터 제3항까지에서 규정한 사항 외에 금리인하 요구의 요건 및 절차에 관하여 필요한 세부 사항은 행정안전부장관이 정하여 고시한다.
