상표법 제36조(상표등록출원)

① 상표등록을 받으려는 자는 다음 각 호의 사항을 적은 상표등록출원서를 지식재산처장에게 제출하여야 한다. <개정 2025.10.1>

② 상표등록을 받으려는 자는 제1항 각 호의 사항 외에 총리령으로 정하는 바에 따라 그 표장에 관한 설명을 상표등록출원서에 적어야 한다. <개정 2025.10.1>

③ 단체표장등록을 받으려는 자는 제1항 각 호의 사항 외에 대통령령으로 정하는 단체표장의 사용에 관한 사항을 정한 정관을 단체표장등록출원서에 첨부하여야 한다.

④ 증명표장등록을 받으려는 자는 제1항 각 호의 사항 외에 대통령령으로 정하는 증명표장의 사용에 관한 사항을 정한 서류(법인인 경우에는 정관을 말하고, 법인이 아닌 경우에는 규약을 말하며, 이하 "정관 또는 규약"이라 한다)와 증명하려는 상품의 품질, 원산지, 생산방법이나 그 밖의 특성을 증명하고 관리할 수 있음을 증명하는 서류를 증명표장등록출원서에 첨부하여야 한다.

⑤ 지리적 표시 단체표장등록이나 지리적 표시 증명표장등록을 받으려는 자는 제3항 또는 제4항의 서류 외에 대통령령으로 정하는 바에 따라 지리적 표시의 정의에 일치함을 증명할 수 있는 서류를 지리적 표시 단체표장등록출원서 또는 지리적 표시 증명표장등록출원서에 첨부하여야 한다.

⑥ 업무표장등록을 받으려는 자는 제1항 각 호의 사항 외에 그 업무의 경영 사실을 증명하는 서류를 업무표장등록출원서에 첨부하여야 한다.
