상법 제443조(단주의 처리)

①병합에 적당하지 아니한 수의 주식이 있는 때에는 그 병합에 적당하지 아니한 부분에 대하여 발행한 신주를 경매하여 각 주수에 따라 그 대금을 종전의 주주에게 지급하여야 한다. 그러나 거래소의 시세있는 주식은 거래소를 통하여 매각하고, 거래소의 시세없는 주식은 법원의 허가를 받아 경매외의 방법으로 매각할 수 있다. <개정 1984.4.10>
