산업표준화법 제20조(시판품조사 등)

① 산업통상부장관은 소비자단체의 요구가 있는 경우 또는 인증제품 또는 인증서비스의 품질저하로 인하여 다수의 소비자에게 피해가 발생하거나 회복하기 어려운 피해가 발생할 우려가 현저하다고 인정하는 경우에는 대통령령으로 정하는 바에 따라 공무원이나 인증심사원으로 하여금 판매되고 있는 인증제품에 대한 품질시험(이하 "시판품조사"라 한다)을 하게 하거나 인증받은자의 공장 또는 사업장에서 그 제품 또는 서비스를 조사(이하 "현장조사"라 한다)하게 할 수 있다. <개정 2008.2.29, 2013.3.23, 2015.1.28, 2025.10.1>

② 산업통상부장관은 인증받은자(제16조제1항제1호에 따라 서비스의 종류별로 인증을 받은 자로 한정한다. 이하 이 항에서 같다)의 일부 사업장에서 현장조사를 한 결과 서비스 품질보증에 대한 종합점검이 필요하다고 인정되는 경우에는 공무원이나 인증심사원으로 하여금 인증받은자의 다른 사업장 및 주된 사무소에 대하여 조사하게 할 수 있다. <신설 2015.1.28, 2025.10.1>

③ 산업통상부장관은 제1항에 따른 시판품조사ㆍ현장조사 또는 제2항에 따른 조사 결과 그 인증제품 또는 인증서비스가 한국산업표준 또는 인증심사기준에 맞지 아니하다고 인정하는 때에는 해당 인증기관에 그 사실을 통보하여야 한다. <개정 2008.2.29, 2013.3.23, 2015.1.28, 2025.10.1>

④ 산업통상부장관은 제1항에 따른 현장조사 또는 제2항에 따른 조사를 하게 하는 경우에는 조사 7일 전까지 조사일시, 조사이유 및 조사내용 등에 대한 조사계획을 조사를 받을 자에게 통지하여야 한다. 다만, 긴급을 요하거나 사전통지의 경우 증거인멸 등으로 조사의 목적을 달성할 수 없다고 인정하는 경우에는 그러하지 아니하다. <개정 2008.2.29, 2013.3.23, 2015.1.28, 2025.10.1>

⑤ 제1항에 따른 현장조사를 하거나 제2항에 따른 조사를 하는 자는 그 권한을 나타내는 증표를 지니고 이를 관계인에게 내보여야 하며, 출입이 필요한 경우에는 성명ㆍ출입시간ㆍ출입목적 등이 표시된 문서를 관계인에게 교부하여야 한다. <개정 2015.1.28>
