Enforcement Decree of the Occupational Safety and Health Act, Article 89 (Buildings and Equipment Subject to Institutional Asbestos Surveys)
① 법 제119조제2항 각 호 외의 부분 본문에서 "대통령령으로 정하는 규모 이상"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다.
(1) The term "at least the size prescribed by Presidential Decree" in the main text of Article 119 (2) of the Act, other than its subparagraphs, means any of the following cases:
1. 건축물(제2호에 따른 주택은 제외한다. 이하 이 호에서 같다)의 연면적 합계가 50제곱미터 이상이면서, 그 건축물의 철거ㆍ해체하려는 부분의 면적 합계가 50제곱미터 이상인 경우
1. Where the total floor area of a building (excluding housing under subparagraph 2; the same applies hereinafter in this subparagraph) is at least 50 square meters and the total area of the parts of the building to be demolished or dismantled is at least 50 square meters;
2. 주택(「건축법 시행령」 제2조제12호에 따른 부속건축물을 포함한다. 이하 이 호에서 같다)의 연면적 합계가 200제곱미터 이상이면서, 그 주택의 철거ㆍ해체하려는 부분의 면적 합계가 200제곱미터 이상인 경우
2. Where the total floor area of housing (including annexed buildings under Article 2, subparagraph 12 of the Enforcement Decree of the Building Act; the same applies hereinafter in this subparagraph) is at least 200 square meters and the total area of the parts of the housing to be demolished or dismantled is at least 200 square meters;
3. 설비의 철거ㆍ해체하려는 부분에 다음 각 목의 어느 하나에 해당하는 자재(물질을 포함한다. 이하 같다)를 사용한 면적의 합이 15제곱미터 이상 또는 그 부피의 합이 1세제곱미터 이상인 경우
3. Where, in the parts of equipment to be demolished or dismantled, the total area in which any of the following materials (including substances; the same applies hereinafter) are used is at least 15 square meters or their total volume is at least one cubic meter:
가. 단열재
(a) Insulation materials;
나. 보온재
(b) Thermal insulation materials;
다. 분무재
(c) Spray-applied materials;
라. 내화피복재(耐火被覆材)
(d) Fireproof coating materials;
마. 개스킷(Gasket: 누설방지재)
(e) Gaskets (Gasket: leak prevention materials);
바. 패킹재(Packing material: 틈박이재)
(f) Packing materials (Packing material: gap-filling materials);
사. 실링재(Sealing material: 액상 메움재)
(g) Sealing materials (Sealing material: liquid filling materials);
아. 그 밖에 가목부터 사목까지의 자재와 유사한 용도로 사용되는 자재로서 고용노동부장관이 정하여 고시하는 자재
(h) Other materials used for purposes similar to the materials under items (a) through (g), as determined and publicly notified by the Minister of Employment and Labor;
4. 파이프 길이의 합이 80미터 이상이면서, 그 파이프의 철거ㆍ해체하려는 부분의 보온재로 사용된 길이의 합이 80미터 이상인 경우
4. Where the total length of pipes is at least 80 meters and the total length of thermal insulation materials used in the parts of the pipes to be demolished or dismantled is at least 80 meters.
② 법 제119조제2항 각 호 외의 부분 단서에서 "석면함유 여부가 명백한 경우 등 대통령령으로 정하는 사유"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다. <개정 2020.9.8>
(2) The term "ground prescribed by Presidential Decree, such as where it is clear whether asbestos is contained" in the proviso of Article 119 (2) of the Act, other than its subparagraphs, means any of the following cases:
1. 건축물이나 설비의 철거ㆍ해체 부분에 사용된 자재가 설계도서, 자재 이력 등 관련 자료를 통해 석면을 포함하고 있지 않음이 명백하다고 인정되는 경우
1. Where it is recognized as clear, from related materials such as design documents and material histories, that the materials used in the parts of a building or equipment to be demolished or dismantled do not contain asbestos;
2. 건축물이나 설비의 철거ㆍ해체 부분에 석면이 중량비율 1퍼센트가 넘게 포함된 자재를 사용하였음이 명백하다고 인정되는 경우
2. Where it is recognized as clear that materials containing more than 1 percent asbestos by weight have been used in the parts of a building or equipment to be demolished or dismantled.
