산림조합법 제40조(선거운동의 제한)
Forestry Cooperatives Act, Article 40 (Restrictions on Election Campaigns)
① 누구든지 자기 또는 특정인을 조합의 임원 또는 대의원으로 당선되거나 당선되게 하거나 당선되지 못하게 할 목적으로 다음 각 호의 어느 하나의 행위를 할 수 없다.
(1) No one may perform any of the following acts for the purpose of getting himself or herself or a specific person elected, or getting a person elected or not elected, as an officer or delegate of a cooperative:
1. 선거인(선거인 명부 작성 전에는 그 선거인 명부에 오를 자격이 있는 사람으로서 이미 조합에 가입한 사람 또는 조합에 가입신청을 한 사람을 포함한다. 이하 같다)이나 그 가족(선거인의 배우자, 선거인 또는 그 배우자의 직계 존속ㆍ비속과 형제자매, 선거인의 직계 존속ㆍ비속 및 형제자매의 배우자를 말한다. 이하 같다) 또는 선거인이나 그 가족이 설립ㆍ운영하고 있는 기관ㆍ단체ㆍ시설에 금전ㆍ물품ㆍ향응, 그 밖의 재산상 이익 또는 공사(公私)의 직의 제공, 제공의 의사표시 또는 그 제공을 약속하는 행위
1. Providing, expressing the intention to provide, or promising to provide money, goods, entertainment or other financial benefits or public or private positions to an elector (before preparation of the electors' list, including a person qualified to be on the list who has already joined the cooperative or applied to join the cooperative; the same applies hereinafter) or his or her family (meaning the spouse of the elector, lineal ascendants and descendants and siblings of the elector or of the elector's spouse, and the spouses of lineal ascendants and descendants and siblings of the elector; the same applies hereinafter), or an institution, organization or facility established or operated by the elector or his or her family;
2. 후보자가 되지 아니하도록 하거나 후보자가 된 사람을 사퇴하게 할 목적으로 후보자가 되려는 사람이나 후보자에게 제1호에 규정된 행위를 하는 행위
2. Performing the act under subparagraph 1 toward a person intending to be a candidate or toward a candidate, for the purpose of preventing him or her from becoming a candidate or having a person who became a candidate withdraw;
3. 제1호 또는 제2호에 규정된 이익이나 직을 제공받거나 그 제공의 의사표시를 승낙하는 행위
3. Receiving a benefit or position prescribed in subparagraph 1 or 2, or accepting an expression of intention to provide it;
4. 제1호 또는 제2호에 규정된 이익이나 직의 제공을 요구하거나 알선하는 행위
4. Demanding or brokering the provision of a benefit or position prescribed in subparagraph 1 or 2.
② 임원 또는 대의원이 되려는 사람은 선거운동을 위하여 선거일 공고일부터 선거일까지 선거인을 호별로 방문하거나 특정 장소에 모이게 할 수 없다.
(2) A person intending to become an officer or delegate may not visit electors from house to house or gather them at a specific place for election campaign purposes from the date of public notice of the election day to the election day.
③ 누구든지 조합의 임원 또는 대의원 선거와 관련하여 연설ㆍ벽보 또는 그 밖의 방법으로 거짓의 사실을 공표하거나 공연히 사실을 적시(摘示)하여 후보자를 비방할 수 없다.
(3) No one may, in connection with an election of officers or delegates of a cooperative, publicize false facts by speech, posters or other means, or publicly allege facts to defame a candidate.
④ 누구든지 특정 임원의 선거에 투표할 목적으로 거짓된 방법으로 선거인 명부에 오르게 할 수 없다. <개정 2020.3.24>
(4) No one may cause a person to be placed on the electors' list by false means for the purpose of voting in the election of a specific officer.
⑤ 누구든지 해당 후보자의 등록이 끝난 때부터 선거일 전일까지 외에 선거운동을 할 수 없다.
(5) No one may conduct an election campaign other than from the time of completion of registration of the candidate concerned until the day before the election day.
⑥ 누구든지 자기 또는 특정인을 당선되게 하거나 당선되지 못하게 할 목적으로 선거기간 중 포장된 선물 또는 돈 봉투 등 다수의 조합원(조합원의 가족 또는 조합원이나 그 가족이 설립ㆍ운영하고 있는 기관ㆍ단체 또는 시설을 포함한다)에게 배부하도록 구분된 형태로 되어 있는 금품을 운반하여서는 아니 된다.
(6) No one may, for the purpose of getting himself or herself or a specific person elected or not elected, during the election period, carry wrapped gifts, envelopes of money or other money or goods packaged in a form divided for distribution to many members (including family members of members, or institutions, organizations or facilities established or operated by members or their families).
⑦ 누구든지 조합선거관리위원회의 위원ㆍ직원, 그 밖에 선거사무에 종사하는 사람을 폭행ㆍ협박ㆍ유인 또는 체포ㆍ감금하거나 폭행이나 협박을 가하여 투표소 또는 선거관리위원회 사무소를 소요ㆍ교란하거나, 투표용지ㆍ투표지ㆍ투표보조용구ㆍ전산조직 등 선거관리 및 단속사무와 관련한 시설ㆍ설비ㆍ장비ㆍ서류ㆍ인장 또는 선거인 명부를 은닉ㆍ파손ㆍ훼손 또는 탈취하여서는 아니 된다. <개정 2014.6.11>
(7) No one may assault, threaten, lure, arrest or confine members or employees of the cooperative election management committee or other persons engaged in election affairs, nor assault or threaten them to cause disturbance or disruption at a polling place or the office of the election management committee, nor conceal, destroy, damage or seize ballot papers, ballots, voting aids, computer systems or other facilities, equipment, documents, seals or electors' lists related to election management and enforcement affairs.
⑧ 누구든지 임원선거와 관련하여 다음 각 호의 행위 외의 선거운동을 할 수 없다.
(8) No one may conduct election campaigns in connection with officer elections other than the following acts:
1. 선전벽보의 부착
1. Posting promotional posters;
2. 선거공보의 배부
2. Distributing election bulletins;
3. 도로ㆍ시장 등 농림축산식품부령으로 정하는 곳으로서 많은 사람이 왕래하거나 모이는 공개된 장소에서의 지지 호소 및 명함 배부
3. Appealing for support and distributing business cards at open places where many people pass or gather, such as roads and markets, as prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs;
4. 합동연설회 또는 공개토론회의 개최
4. Holding joint speech meetings or open debates;
5. 전화(문자메시지를 포함한다), 컴퓨터통신(전자우편을 포함한다)을 이용한 지지 호소
5. Appealing for support using the telephone (including text messages) or computer communications (including e-mail).
⑨ 조합의 임직원은 다음 각 호의 어느 하나에 해당하는 행위를 할 수 없다.
(9) Officers and employees of a cooperative may not perform any of the following acts:
1. 지위를 이용하여 선거운동을 하는 행위
1. Conducting an election campaign by exploiting their position;
2. 선거운동의 기획에 참여하거나 그 기획의 실시에 관여하는 행위
2. Participating in planning an election campaign or being involved in carrying out such a plan;
3. 후보자(후보자가 되려는 사람을 포함한다. 이하 같다)에 대한 조합원의 지지도를 조사하거나 발표하는 행위
3. Surveying or publishing the level of members' support for a candidate (including a person intending to be a candidate; the same applies hereinafter).
⑩ 제8항에 따른 선거운동의 방법과 기준 등 그 밖에 필요한 사항은 농림축산식품부령으로 정한다. <개정 2023.6.20>
(10) The methods and criteria of election campaigns under paragraph (8) and other necessary matters shall be prescribed by Ordinance of the Ministry of Agriculture, Food and Rural Affairs.
