산림조합법 제35조(임원의 정수 및 선출)

① 조합에 임원으로서 조합장 1명을 포함한 7명 이상 15명 이하의 이사와 2명의 감사를 두되, 그 정수는 정관으로 정한다. 이 경우 이사 중 2분의 1 이상은 조합원이어야 한다.

② 조합은 정관으로 정하는 바에 따라 제1항에 따른 조합장을 포함한 이사 중 2명 이내를 상임(常任)으로 할 수 있다. 다만, 자산 등 조합의 사업규모가 대통령령으로 정하는 기준 미만인 경우에는 조합장을 상임으로 하며, 조합장을 비상임으로 운영하는 조합의 경우에는 상임이사를 두어야 한다. <개정 2020.3.24>

③ 제2항 본문에도 불구하고 자산 등 조합의 사업규모가 대통령령으로 정하는 기준 이상에 해당하는 경우에는 조합장을 비상임으로 한다. <신설 2020.3.24>

④ 조합장은 조합원 중에서 정관으로 정하는 바에 따라 다음 각 호의 어느 하나의 방법으로 선출한다. <개정 2020.3.24>

⑤ 조합장 외의 임원은 총회에서 선출한다. 다만, 상임이사는 조합업무에 대한 전문지식과 경험이 풍부한 사람으로서 대통령령으로 정하는 요건을 갖춘 사람 중에서 조합장이 이사회의 동의를 받아 추천한 사람을 총회에서 선출한다. <개정 2020.3.24>

⑥ 상임인 임원을 제외한 조합의 임원은 명예직으로 한다. <개정 2020.3.24>

⑦ 조합장 선거에 입후보하기 위하여 임기 중 그 직(職)을 그만둔 조합의 이사 및 감사는 그 사직으로 인하여 공석이 된 이사 또는 감사의 보궐선거의 후보자가 될 수 없다. <개정 2020.3.24>

⑧ 지역조합은 이사 중 1명 이상을 여성조합원 중에서 선출하도록 노력하여야 한다. 다만, 여성조합원이 전체 조합원의 100분의 30 이상인 지역조합은 이사 중 1명 이상을 여성조합원 중에서 선출하여야 한다. <신설 2014.3.18, 2020.3.24>

⑨ 임원의 선출 및 추천에 관하여 이 법에서 정한 사항 외에 필요한 사항은 정관으로 정한다. <개정 2014.3.18, 2020.3.24>
