산림보호법 제10조의3(산림유전자원보호구역 관리기본계획의 수립ㆍ시행 등)

① 산림청장은 산림유전자원보호구역의 보호ㆍ관리를 위하여 5년마다 다음 각 호의 사항이 포함된 산림유전자원보호구역 관리기본계획(이하"관리기본계획"이라 한다)을 수립ㆍ시행하여야 한다.

② 산림청장은 관리기본계획에 따라 매년 산림유전자원보호구역 시행계획(이하 이 조에서 "시행계획"이라 한다)을 수립ㆍ시행하고 이에 필요한 재원을 확보하기 위하여 노력하여야 한다. <신설 2019.1.8>

③ 산림청장은 관리기본계획을 수립하거나 변경하려는 경우에는 관계 행정기관의 장 및 지방자치단체의 장과 미리 협의하여야 한다. 다만, 대통령령으로 정하는 경미한 사항을 변경하는 경우에는 그러하지 아니하다. <개정 2019.1.8>

④ 산림청장은 관리기본계획 및 시행계획을 수립하거나 변경한 때에는 농림축산식품부령으로 정하는 바에 따라 이를 공표하여야 하고, 관계 중앙행정기관의 장 및 시ㆍ도지사에게 통보하며, 국회 소관 상임위원회에 제출하여야 한다. <신설 2019.1.8>

⑤ 산림청장은 관리기본계획 및 시행계획의 수립을 위하여 필요한 경우에는 관계 행정기관의 장 및 지방자치단체의 장에게 자료의 제출을 요구할 수 있다. 이 경우 관계 행정기관의 장 및 지방자치단체의 장은 정당한 사유가 없으면 이에 따라야 한다. <개정 2019.1.8, 2020.3.24>

⑥ 시ㆍ도지사와 지방산림청장은 관리기본계획에 따라 5년마다 관할 산림유전자원보호구역에 대한 관리계획(이하 이 조에서 "지역관리계획"이라 한다)을 수립ㆍ시행하여야 한다. <개정 2019.1.8>

⑦ 시ㆍ도지사 또는 지방산림청장은 관리기본계획과 지역관리계획에 따라 매년 연차별 시행계획을 각각 수립ㆍ시행하여야 한다. <개정 2019.1.8>
