사회서비스 지원 및 사회서비스원 설립ㆍ운영에 관한 법률 제42조(지도ㆍ감독 등)

① 보건복지부장관은 중앙 사회서비스원의 업무를 관리ㆍ감독하며, 시ㆍ도지사는 시ㆍ도 서비스원의 업무를 관리ㆍ감독한다.

② 보건복지부장관은 필요한 경우 중앙 사회서비스원 또는 시ㆍ도 서비스원에 대하여 그 업무에 관한 보고 또는 관계 서류의 제출을 명하거나, 소속 공무원으로 하여금 중앙 사회서비스원 또는 시ㆍ도 서비스원의 사무소 또는 시설에 출입하여 검사, 조사 또는 질문을 하게 할 수 있다.

③ 시ㆍ도지사는 필요한 경우 관할 시ㆍ도 서비스원에 대하여 업무에 관한 보고 또는 관계 서류의 제출을 명하거나, 소속 공무원으로 하여금 관할 시ㆍ도 서비스원의 사무소 또는 시설에 출입하여 검사, 조사 또는 질문을 하게 할 수 있다.

④ 제2항 및 제3항에 따라 조사 또는 검사를 하는 공무원은 그 신분을 표시하는 증명서를 지니고 이를 관계인에게 내보여야 한다.

⑤ 제2항 및 제3항에 따라 보고 또는 관계 서류의 제출을 요청받은 자는 특별한 사유가 없으면 그 요청에 따라야 한다.

⑥ 보건복지부장관 또는 시ㆍ도지사는 감독상 필요한 경우 중앙 사회서비스원 또는 시ㆍ도 서비스원에 대하여 정관이나 규정의 변경, 조직의 개편 등 경영개선을 위하여 필요한 시정조치 또는 그 밖에 필요한 처분을 명할 수 있다.
