사회복지사업법 시행령 제8조의2(이사 추천의 절차 등)

① 사회복지법인은 법 제18조제2항에 따라 이사의 추천을 받으려면 이사의 선임사유가 발생한 날부터 15일 이내에 같은 항 각 호의 어느 하나에 해당하는 기관에 법인의 설립 취지, 목적사업의 내용 및 이사가 갖추어야 할 사항 등에 관한 자료를 첨부하여 서면으로 이사의 추천을 요청하여야 한다. 다만, 선임사유가 이사의 임기만료인 경우에는 임기만료 3개월 전부터 추천을 요청할 수 있다.

② 제1항에 따라 이사의 추천 요청을 받은 기관은 특별한 사유가 없으면 그 요청을 받은 날부터 30일 이내에 해당 법인의 설립 목적을 고려하여 이사를 추천하여야 하며, 필요한 경우 이사의 추천 요청을 한 자로부터 의견을 들을 수 있다.

③ 제1항에 따라 이사의 추천 요청을 받은 기관은 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장에게 제2항에 따라 이사로 추천하려는 사람이 법 제19조에 따른 결격사유에 해당하는지 확인해 줄 것을 요청할 수 있다. 이 경우 이사로 추천하려는 사람의 동의를 받아야 한다.

④ 제3항에 따라 확인 요청을 받은 시ㆍ도지사 또는 시장ㆍ군수ㆍ구청장은 특별한 사유가 없으면 이에 따라야 한다.
