사회보장급여의 이용ㆍ제공 및 수급권자 발굴에 관한 법률 제9조(사회보장급여 제공의 결정)

① 보장기관의 장이 제6조 및 제7조에 따른 조사를 실시한 경우에는 사회보장급여의 제공 여부 및 제공 유형을 결정하되, 제공하고자 하는 사회보장급여는 지원대상자가 현재 제공받고 있는 사회보장급여와 보장내용이 중복되도록 하여서는 아니 된다.

② 보장기관의 장은 사회보장급여의 제공 결정에 필요한 경우 지원대상자와 그 친족, 그 밖에 관계인의 의견을 들을 수 있다.

③ 보장기관의 장은 제1항에 따라 결정된 사회보장급여의 제공 여부와 그 유형 및 변경사항 신고의무 등을 서면(신청인의 동의에 의한 전자문서를 포함한다)으로 신청인에게 통지하여야 하며, 필요한 경우 구두 등의 방법을 병행할 수 있다. 이 경우 통지에 필요한 사항은 대통령령으로 정한다.

④ 보장기관의 장이 제1항에 따른 사회보장급여의 제공 여부 및 제공 유형을 결정할 때 제7조제4항 또는 제8조제2항에 따라 제공받은 자료ㆍ정보의 전부 또는 일부를 통해 평가한 지원대상자와 그 부양의무자의 소득ㆍ재산 수준이 보건복지부장관이 정하는 기준 이하인 경우에는 소득ㆍ재산 관련 조사의 일부를 생략하고 사회보장급여의 지급을 결정할 수 있다. <신설 2020.12.29>
