사회보장급여의 이용ㆍ제공 및 수급권자 발굴에 관한 법률 제21조(사회보장급여의 변경ㆍ중지)

① 보장기관의 장은 제19조에 따른 사회보장급여의 적정성 확인조사 및 제20조에 따른 수급자의 변동신고에 따라 수급자 및 그 부양의무자의 인적사항, 가족관계, 소득ㆍ재산 상태, 근로능력 등에 변동이 있는 경우에는 직권 또는 수급자나 그 친족, 그 밖의 관계인의 신청에 따라 수급자에 대한 사회보장급여의 종류ㆍ지급방법 등을 변경할 수 있다.

② 보장기관의 장은 제1항에 따른 변동으로 수급자에 대한 사회보장급여의 전부 또는 일부가 필요 없게 된 때에는 사회보장급여의 전부 또는 일부를 중지하거나 그 종류ㆍ지급방법 등을 변경하여야 한다. 다만, 제1항에 따른 변동이 소득ㆍ재산 상태 등의 변동수준, 수급기간 등을 고려하여 보건복지부장관이 정하는 기준에 해당하는 경우에는 그러하지 아니하다. <개정 2020.12.29>

③ 제1항 또는 제2항에 따른 사회보장급여의 변경 또는 중지는 서면(수급자의 동의에 의한 전자문서를 포함한다)으로 그 이유를 명시하여 수급자에게 통지하여야 하며, 필요한 경우 구두 등의 방법을 병행할 수 있다.
