Special Act on the Regulation and Punishment of Speculative Acts, etc., Article 2 (Definitions)

① 이 법에서 사용하는 용어의 뜻은 다음과 같다.

2. "사행행위영업"이란 다음 각 목의 어느 하나에 해당하는 영업을 말한다.

가. 복권발행업(福券發行業): 특정한 표찰(컴퓨터프로그램 등 정보처리능력을 가진 장치에 의한 전자적 형태를 포함한다)을 이용하여 여러 사람으로부터 재물등을 모아 추첨 등의 방법으로 당첨자에게 재산상의 이익을 주고 다른 참가자에게 손실을 주는 행위를 하는 영업

나. 현상업(懸賞業): 특정한 설문 또는 예측에 대하여 그 답을 제시하거나 예측이 적중하면 이익을 준다는 조건으로 응모자로부터 재물등을 모아 그 정답자나 적중자의 전부 또는 일부에게 재산상의 이익을 주고 다른 참가자에게 손실을 주는 행위를 하는 영업

다. 그 밖의 사행행위업: 가목 및 나목 외에 영리를 목적으로 회전판돌리기, 추첨, 경품(景品) 등 사행심을 유발할 우려가 있는 기구 또는 방법 등을 이용하는 영업으로서 대통령령으로 정하는 영업

3. "사행기구 제조업"이란 사행행위영업에 이용되는 기계, 기판(機板), 용구(用具) 또는 컴퓨터프로그램(이하 "사행기구"라 한다)을 제작ㆍ개조하거나 수리하는 영업을 말한다.

4. "사행기구 판매업"이란 사행기구를 판매하거나 수입(輸入)하는 영업을 말한다.
