손실을 입은 자와 시ㆍ도지사 또는 지방산림청장은 제7조제2항의 규정에 의한 보상금의 협의가 이루어지지 아니하였거나 손실보상 결정금액에 이의가 있을 때에는 법 제12조의 규정에 의하여 손실발생의 원인이 된 행위가 종료한 날부터 1년이내에 이유서를 첨부하여 그 토지를 관할하는 토지수용위원회에 재결신청을 하여야 한다. <개정 1995.12.29, 2002.3.2, 2006.1.26>
