비송사건절차법 제45조(재판상 대위의 신청)

채권자는 자기 채권의 기한 전에 채무자의 권리를 행사하지 아니하면 그 채권을 보전할 수 없거나 보전하는 데에 곤란이 생길 우려가 있을 때에는 재판상의 대위(代位)를 신청할 수 있다.
