Enforcement Decree of the Emergency Preparedness Resources Management Act, Article 10 (Designation of Resources Subject to Priority Management, etc.)

① 법 제11조제1항에 따라 중점 관리해야 할 인력ㆍ물자 또는 업체를 지정하는 경우 인력에 대해서는 행정안전부장관이 지정하고, 물자와 업체에 대해서는 소관 자원관리주관기관의 장이 지정한다. 다만, 물자 또는 업체의 소관이 분명하지 않거나 2개 부처 이상에 관련되는 경우에는 국무총리가 소관 자원관리주관기관의 장을 지정한다. <개정 2013.3.23, 2014.11.19, 2017.7.26, 2022.7.4>

② 자원관리주관기관의 장이 법 제11조제1항에 따라 중점 관리해야 할 인력ㆍ물자 또는 업체를 지정하는 경우에는 소관 비상대비업무를 수행하기 위하여 필요한 최소한의 범위에서 지정하되 다음 각 호의 사항을 고려하여야 한다. <개정 2022.7.4>

③ 자원관리주관기관의 장이 법 제11조제1항에 따라 중점 관리해야 할 인력ㆍ물자 또는 업체를 지정하는 경우에는 다음 각 호의 구분에 따른 사항을 구체적으로 밝혀 지정을 받는 인력자원대상자, 물자의 소유자 또는 업체의 장에게 지체 없이 고지서를 송달하여야 한다. <개정 2022.7.4>

⑤ 자원관리주관기관의 장이 법 제11조제1항에 따라 지정된 인력ㆍ물자 또는 업체(이하 "중점관리대상자원"이라 한다)를 같은 조 제3항에 따라 지정 해제하려는 경우에는 미리 중점관리대상자원이 비상대비업무를 수행하기에 적합한지를 조사해야 한다. <신설 2012.8.23, 2022.7.4>

⑥ 자원관리주관기관의 장이 법 제11조제3항에 따라 중점관리대상자원의 지정을 해제한 경우에는 지체 없이 해당 인력자원대상자, 물자의 소유자 또는 업체의 장에게 지정해제 사실을 문서로 알려주어야 한다. <신설 2012.8.23, 2022.7.4>
