Act on Registration of Real Estate under Real Titleholder's Name, Article 5-2 (Extension of Penalty Surcharge Payment Deadline and Payment in Installments)

① 특별자치도지사ㆍ특별자치시장ㆍ시장ㆍ군수 또는 구청장은 제5조제1항에 따른 과징금을 부과받은 자(이하 이 조에서 "과징금 납부의무자"라 한다)가 과징금의 금액이 대통령령으로 정하는 기준을 초과하는 경우로서 다음 각 호의 어느 하나에 해당하여 과징금의 전액을 일시에 납부하기가 어렵다고 인정할 때에는 그 납부기한을 연장하거나 분할 납부하게 할 수 있다. 이 경우 필요하다고 인정할 때에는 대통령령으로 정하는 바에 따라 담보를 제공하게 할 수 있다.

② 과징금 납부의무자가 제1항에 따른 과징금 납부기한의 연장 또는 분할 납부를 신청하려는 경우에는 과징금 납부를 통지받은 날부터 30일 이내에 특별자치도지사ㆍ특별자치시장ㆍ시장ㆍ군수 또는 구청장에게 신청하여야 한다.

③ 특별자치도지사ㆍ특별자치시장ㆍ시장ㆍ군수 또는 구청장은 제1항에 따라 납부기한이 연장되거나 분할 납부가 허용된 과징금 납부의무자가 다음 각 호의 어느 하나에 해당하게 된 때에는 그 납부기한의 연장 또는 분할 납부 결정을 취소하고 일시에 징수할 수 있다.
