부담금관리 기본법 제8조(부담금운용의 평가)

① 기획예산처장관은 부담금을 적정하게 운용하기 위하여 각 부담금의 부과목적, 부과실태, 사용내용의 건전성, 부과절차의 공정성 및 존치 필요성 등을 지속적으로 점검ㆍ평가하여야 한다. 이 경우 각 부담금의 존치 필요성에 대해서는 3년마다 1회씩 점검ㆍ평가하고 그 결과를 제7조제2항에 따른 부담금운용종합보고서에 포함하여 국회에 제출하여야 한다. <개정 2015.12.29, 2025.10.1>

② 기획예산처장관은 제1항에 따른 평가 결과, 부담금의 운용이 적정하지 아니하였거나 부담금을 존치할 필요성이 없어졌다고 인정하는 경우에는 부담금의 소관 중앙행정기관의 장에게 해당 부담금의 폐지 등을 위한 제도개선을 요청할 수 있다. <개정 2025.10.1>

③ 제2항에 따라 요청을 받은 부담금의 소관 중앙행정기관의 장은 특별한 사유가 없으면 해당 부담금의 폐지 등을 위한 법령의 개정방안, 부담금을 대체할 수 있는 제도의 신설 등의 대책을 마련하여 기획예산처장관과 협의하여야 한다. <개정 2025.10.1>

④ 기획예산처장관은 부담금운용실태를 점검ㆍ평가하거나 부담금제도에 관한 전문적ㆍ기술적인 연구를 하거나 자문하기 위하여 부담금운용평가단을 운영할 수 있다. <개정 2025.10.1>

⑤ 제4항에 따른 부담금운용평가단의 구성 및 운영에 필요한 사항은 대통령령으로 정한다.
