본인서명사실 확인 등에 관한 법률 제5조(본인서명사실확인서의 발급 신청)

① 본인서명사실확인서를 발급받으려는 사람(이하 "신청인"이라 한다) 중 다음 각 호의 어느 하나에 해당하는 사람은 시장ㆍ군수ㆍ구청장(자치구가 아닌 구의 구청장을 포함한다)이나 읍장ㆍ면장ㆍ동장 또는 출장소장(이하 "발급기관"이라 한다)을 직접 방문하여 대통령령으로 정하는 절차와 방법으로 본인서명사실확인서의 발급을 신청하여야 한다. <개정 2016.12.2>

③ 미성년자인 신청인이 제1항에 따라 본인서명사실확인서의 발급을 신청하려는 경우에는 법정대리인과 함께 발급기관을 직접 방문하여 신청하되, 법정대리인의 동의를 받아 신청하여야 한다. <개정 2016.1.27, 2016.12.2>

④ 피한정후견인인 신청인이 「민법」 제13조제1항에 따라 한정후견인의 동의를 필요로 하지 아니하는 행위와 관련하여 본인서명사실확인서의 발급을 신청하려는 경우에는 본인만 발급기관을 직접 방문하여 신청할 수 있다. 다만, 피한정후견인인 신청인이 한정후견인의 동의를 필요로 하는 행위와 관련하여 본인서명사실확인서의 발급을 신청하려는 경우에는 한정후견인과 함께 발급기관을 직접 방문하여 신청하되, 한정후견인의 동의를 받아 신청하여야 한다. <신설 2016.1.27>
