보험사기방지 특별법 시행령 제3조의3(입원적정성 심사 기준 등)

① 「국민건강보험법」 제62조에 따른 건강보험심사평가원(이하 "건강보험심사평가원"이라 한다)은 법 제7조제3항 전단에 따라 법 제4조에 따른 보험계약자등의 입원이 적정한 것인지 여부(이하 "입원적정성"이라 한다)에 대한 심사 기준을 마련할 때에는 다음 각 호의 사항을 고려해야 한다.

② 건강보험심사평가원은 법 제7조제3항 전단에 따라 입원적정성에 대한 심사 기준을 마련하거나 변경한 경우에는 그 내용을 건강보험심사평가원의 홈페이지에 공고해야 한다.

③ 법 제7조제3항 후단에서 "수사기관 등 대통령령으로 정하는 자"란 금융위원회 위원장, 「금융위원회의 설치 등에 관한 법률」에 따른 금융감독원 원장(이하 "금융감독원장"이라 한다), 검찰총장, 중대범죄수사청장, 경찰청장 및 해양경찰청장을 말한다. <개정 2026.9.29>
