보증인 보호를 위한 특별법 제8조(금융기관 보증계약의 특칙)

① 금융기관이 채권자로서 보증계약을 체결할 때에는 「신용정보의 이용 및 보호에 관한 법률」에 따라 종합신용정보집중기관으로부터 제공받은 채무자의 채무관련 신용정보를 보증인에게 제시하고 그 서면에 보증인의 기명날인이나 서명을 받아야 한다. 보증기간을 갱신할 때에도 또한 같다.

② 금융기관이 제1항에 따라 채무자의 채무관련 신용정보를 보증인에게 제시할 때에는 채무자의 동의를 받아야 한다.

(2) When웬 a어 financial^f퍼낸실 institution인스티투션 presents프^r레전츠 the^ð더 debtor's데터즈 debt-related뎃-^r릴레이티드 credit크^r레딧 information인^f퍼메이션 to투 the^ð더 guarantor게^r런토 under언더 paragraph패^r러그^r래^f프 (1), it잇 shall섈 obtain어브테인 the^ð더 debtor's데터즈 consent.컨센트

③ 금융기관이 제1항에 따라 보증인에게 채무관련 신용정보를 제시하지 아니한 경우에는 보증인은 금융기관에 대하여 보증계약 체결 당시 채무자의 채무관련 신용정보를 제시하여 줄 것을 요구할 수 있다.

④ 금융기관이 제3항에 따라 채무관련 신용정보의 제시요구를 받은 날부터 7일 이내에 그 요구에 응하지 아니하는 경우에는 보증인은 그 사실을 안 날부터 1개월 이내에 보증계약의 해지를 통고할 수 있다. 이 경우 금융기관이 해지통고를 받은 날부터 1개월이 경과하면 해지의 효력이 생긴다.
