보증인 보호를 위한 특별법 제7조(보증기간 등)

① 보증기간의 약정이 없는 때에는 그 기간을 3년으로 본다.

② 보증기간은 갱신할 수 있다. 이 경우 보증기간의 약정이 없는 때에는 계약체결 시의 보증기간을 그 기간으로 본다. <개정 2010.3.24>

③ 제1항 및 제2항에서 간주되는 보증기간은 계약을 체결하거나 갱신하는 때에 채권자가 보증인에게 고지하여야 한다. <신설 2010.3.24>

④ 보증계약 체결 후 채권자가 보증인의 승낙 없이 채무자에 대하여 변제기를 연장하여 준 경우에는 채권자나 채무자는 보증인에게 그 사실을 알려야 한다. 이 경우 보증인은 즉시 보증채무를 이행할 수 있다. <개정 2010.3.24>
