병역법 시행령 제18조의8(입영신체검사의 실시)

① 법 제14조의3제7항 전단에서 "병역판정검사장 수용 능력 초과 등 대통령령으로 정하는 사유"란 다음 각 호의 어느 하나에 해당하는 경우를 말한다.

② 입영부대의 장이 법 제14조의3제7항에 따라 입영신체검사를 실시하는 경우에는 입영일부터 7일(토요일 및 공휴일을 포함한다) 이내에 실시해야 한다. 이 경우 입영신체검사는 입영부대의 의료시설에서 실시한다.

③ 입영부대의 장은 제2항에 따른 입영신체검사의 결과 질병 또는 심신장애로 현역, 보충역 또는 승선근무예비역 등의 복무에 적합하지 않거나 15일 이상의 치유기간이 필요하다고 인정되는 사람에 대해서는 군병원에서 정밀신체검사를 실시한 후 그 결과에 따라 귀가시켜야 한다.

④ 입영부대의 장은 제3항에 따른 정밀신체검사 결과 귀가 대상자로 판정된 사람에 대해서는 병역증을 회수하고 귀가증을 교부하여 지체 없이 귀가시키고, 귀가시킨 날부터 2일 이내에 질병이나 심신장애의 정도와 치유기간(치유기간을 알 수 있는 경우만 해당한다)을 명시한 병적기록표, 정밀신체검사 판정서, 병역증 및 귀가자 명부를 지방병무청장[승선근무예비역의 경우에는 관할 지방병무청장(제40조의2제1항에 따른 해운업 또는 수산업 분야 업체의 주된 사무소가 있는 행정구역을 관할하는 지방병무청장이나 병무지청장을 말한다)]에게 송부해야 한다.

⑤ 입영부대의 장은 징집에 의하여 현역병으로 입영한 사람을 해당 군의 병적에 편입한 경우에는 현역 편입자 명부(인사명령서로 갈음할 수 있다)에 주소(시ㆍ군ㆍ구ㆍ읍ㆍ면ㆍ동까지를 기재한다), 성명, 주민등록번호, 입영통지서 일련번호 및 입영일을 명시하여 지체 없이 지방병무청장에게 송부해야 한다.
