변호사시험법 제10조(시험의 합격 결정)

① 법무부장관은 법학전문대학원의 도입 취지를 고려하여 시험의 합격자를 결정하여야 한다. 이 경우 제14조에 따른 변호사시험 관리위원회의 심의 의견과 대법원, 「변호사법」 제78조에 따른 대한변호사협회 및 법학전문대학원 등을 구성원으로 하여 「민법」 제32조와 「공익법인의 설립ㆍ운영에 관한 법률」 제4조에 따라 설립된 법인의 의견을 들어야 한다. <개정 2017.12.12>

② 시험의 합격은 선택형 필기시험과 논술형 필기시험의 점수를 일정한 비율로 환산하여 합산한 총득점으로 결정한다. 다만, 각 과목 중 어느 하나라도 합격최저점수 이상을 취득하지 못한 경우에는 불합격으로 한다.

③ 법조윤리시험은 합격 여부만을 결정하고, 그 성적은 제2항의 총득점에 산입하지 아니한다.

④ 선택형 필기시험과 논술형 필기시험 간의 환산비율, 선택형 및 논술형 필기시험 내에서의 각 과목별 배점비율, 각 과목별 필기시험의 합격최저점수, 법조윤리시험의 합격에 필요한 점수, 성적의 세부산출방법, 그 밖에 시험의 합격 결정방법은 대통령령으로 정한다.
