배타적 경제수역에서의 외국인어업 등에 대한 주권적 권리의 행사에 관한 법률 제23조(위반 선박 등에 대한 사법절차)

① 검사나 사법경찰관은 이 법, 이 법에 따른 명령 또는 제한이나 조건을 위반한 선박 또는 그 선박의 선장이나 그 밖의 위반자에 대하여 정선, 승선, 검색, 나포(拿捕) 등 필요한 조치를 할 수 있다.

② 사법경찰관은 제1항의 조치를 하였을 때에는 그 결과를 검사에게 보고하되, 사정이 급하여 미리 지휘를 받을 수 없는 경우를 제외하고는 검사의 지휘를 받아 제1항의 조치를 하여야 한다.

③ 검사는 제1항의 조치를 하였거나 제2항에 따른 보고를 받았을 때에는 선장이나 그 밖의 위반자에게 지체 없이 다음 각 호의 사항을 고지하여야 한다. 다만, 대통령령으로 정하는 외국인이 하는 어업활동등에 대하여는 그러하지 아니하다. <개정 2012.5.14>

④ 검사는 제3항에 따라 고지된 담보금 또는 그 제공을 보증하는 서류를 받았을 때에는 지체 없이 선장이나 그 밖의 위반자를 석방하고 선박을 반환하여야 한다. <개정 2012.5.14>

⑤ 제3항제2호에 따른 담보금의 금액은 위반행위에 대하여 이 법에서 규정된 벌금액을 원칙으로 하되, 대통령령으로 정하는 기준에 따라 검사가 위반 사항의 내용과 위반횟수, 그 밖의 사정을 고려하여 정한다. <개정 2012.5.14, 2026.5.12>
