방송통신발전 기본법 시행령 제23조의2(통신재난관리심의위원회의 구성)

Enforcement Decree of the Framework Act on the Development of Broadcasting and Communications, Article 23-2 (Composition of the Telecommunications Disaster Management Deliberation Committee)

① 법 제35조의2제1항에 따른 통신재난관리심의위원회(이하 "통신재난관리심의위원회"라 한다)는 위원장 1명을 포함하여 11명 이상 15명 이내의 위원으로 구성한다.

② 통신재난관리심의위원회 위원장은 과학기술정보통신부차관 중 과학기술정보통신부장관이 지명하는 차관으로 하고, 통신재난관리심의위원회 위원은 다음 각 호의 사람 중에서 과학기술정보통신부장관이 성별을 고려하여 임명하거나 위촉한다.

④ 과학기술정보통신부장관은 위촉위원이 다음 각 호의 어느 하나에 해당하는 경우에는 해당 위원을 해촉(解囑)할 수 있다.

1. 심신장애로 직무를 수행할 수 없게 된 경우

2. 직무와 관련된 비위사실이 있는 경우

⑤ 통신재난관리심의위원회 위원장은 통신재난관리심의위원회를 대표하고, 통신재난관리심의위원회의 업무를 총괄한다.

⑥ 통신재난관리심의위원회 위원장이 부득이한 사유로 직무를 수행할 수 없는 경우에는 위원장이 미리 지명한 위원이 그 직무를 대행한다.

⑦ 통신재난관리심의위원회의 회의는 재적위원 과반수의 출석으로 개의(開議)하고, 출석위원 과반수의 찬성으로 의결한다.

⑧ 통신재난관리심의위원회에 간사 1명을 두며, 간사는 과학기술정보통신부 소속 공무원 중에서 과학기술정보통신부장관이 지명한다.

⑨ 통신재난관리심의위원회는 심의사항과 관련하여 필요하다고 인정하는 경우에는 관련 사업자나 관계인을 출석하게 하여 의견을 듣거나 설명하게 할 수 있다.

⑩ 과학기술정보통신부장관은 통신재난관리심의위원회 위원에게 예산의 범위에서 수당, 여비와 심의 내용에 대한 검토 경비를 지급할 수 있다. 다만, 공무원인 위원이 그 소관 업무와 직접적으로 관련되어 위원회에 출석하거나 심의 내용에 대해 검토하는 경우에는 지급하지 않는다.
