민법 제482조(변제자대위의 효과, 대위자간의 관계)

5. 자기의 재산을 타인의 채무의 담보로 제공한 자와 보증인간에는 그 인원수에 비례하여 채권자를 대위한다. 그러나 자기의 재산을 타인의 채무의 담보로 제공한 자가 수인인 때에는 보증인의 부담부분을 제외하고 그 잔액에 대하여 각 재산의 가액에 비례하여 대위한다. 이 경우에 그 재산이 부동산인 때에는 제1호의 규정을 준용한다.
