민법 제136조(단독행위와 무권대리)

단독행위에는 그 행위당시에 상대방이 대리인이라 칭하는 자의 대리권없는 행위에 동의하거나 그 대리권을 다투지 아니한 때에 한하여 전6조의 규정을 준용한다. 대리권없는 자에 대하여 그 동의를 얻어 단독행위를 한 때에도 같다.
