민법 제1085조(제삼자의 권리의 목적인 물건 또는 권리의 유증)

유증의 목적인 물건이나 권리가 유언자의 사망 당시에 제삼자의 권리의 목적인 경우에는 수증자는 유증의무자에 대하여 그 제삼자의 권리를 소멸시킬 것을 청구하지 못한다.
