민간임대주택에 관한 특별법 제5조의5(청약 철회 및 가입비등의 반환 등)

① 조합가입신청자가 민간임대협동조합 가입 계약을 체결하면 모집주체는 조합가입신청자로 하여금 계약 체결 시 납부하여야 하는 일체의 금전(이하 "가입비등"이라 한다)을 대통령령으로 정하는 기관(이하 "예치기관"이라 한다)에 예치하게 하여야 한다.

② 조합가입신청자는 민간임대협동조합 가입 계약체결일부터 30일 이내에 민간임대협동조합 가입에 관한 청약을 철회할 수 있다.

(2) An앤 applicant애플리컨트 for^f포 membership멤버쉽 may메이 withdraw위^ð드드^r로 the^ð더 subscription서브스크^r립션 to투 join조인 a어 private프^r라이^v벗 rental^r렌틀 cooperative코아퍼^r레이티^v브 within위^ð딘 30 days데이즈 from^f프^r럼 the^ð더 date데잇 of어^v브 concluding컨클루딩 the^ð더 contract칸트^r랙트 to투 join조인 the^ð더 private프^r라이^v벗 rental^r렌틀 cooperative.코아퍼^r레이티^v브

③ 청약 철회를 서면으로 하는 경우에는 청약 철회의 의사를 표시한 서면을 발송한 날에 그 효력이 발생한다.

④ 모집주체는 조합가입신청자가 청약 철회를 한 경우 청약 철회 의사가 도달한 날부터 7일 이내에 예치기관의 장에게 가입비등의 반환을 요청하여야 한다.

(4) Where웨어 an앤 applicant애플리컨트 for^f포 membership멤버쉽 has해즈 withdrawn위^θ스드^r론 the^ð더 subscription,서브스크^r립션 the^ð더 recruiting^r러크^r루팅 entity엔터티 shall섈 request^r리퀘스트 the^ð더 head헤드 of어^v브 the^ð더 depository디파저토^r리 institution인스티투션 to투 return^r리턴 the^ð더 membership멤버쉽 fees,^f피즈 etc.엣세터^r러 within위^ð딘 seven세^v븐 days데이즈 from^f프^r럼 the^ð더 date데잇 the^ð디 intention인텐천 to투 withdraw위^ð드드^r로 arrives.어^r라이^v브즈

⑤ 예치기관의 장은 제4항에 따른 가입비등의 반환 요청을 받은 경우 요청일부터 10일 이내에 가입비등을 조합가입신청자에게 반환하여야 한다.

⑥ 조합가입신청자가 제2항에 따른 기간 이내에 청약 철회를 하는 경우 모집주체는 조합가입신청자에게 청약 철회를 이유로 위약금 또는 손해배상을 청구할 수 없다.

(6) Where웨어 an앤 applicant애플리컨트 for^f포 membership멤버쉽 withdraws위^ð드드^r로즈 the^ð더 subscription서브스크^r립션 within위^ð딘 the^ð더 period피^r리어드 under언더 paragraph패^r러그^r래^f프 (2), the^ð더 recruiting^r러크^r루팅 entity엔터티 may메이 not낫 claim클레임 a어 penalty페널티 or오 damages대머지즈 from^f프^r럼 the^ð디 applicant애플리컨트 on안 the^ð더 ground그^r라운드 of어^v브 the^ð더 withdrawal.위^ð드드^r로얼

⑦ 제1항에 따라 예치된 가입비등의 관리, 지급 및 반환 등에 필요한 사항은 대통령령으로 정한다.
