민간임대주택에 관한 특별법 제39조의2(준공검사)

① 시행자가 촉진지구 조성사업의 공사를 완료한 때에는 국토교통부령으로 정하는 바에 따라 공사완료 보고서를 작성하여 시장ㆍ군수ㆍ구청장에게 준공검사를 받아야 한다. 다만, 시행자가 한국토지주택공사 또는 지방공사인 경우에는 시장ㆍ군수ㆍ구청장의 준공검사 권한을 한국토지주택공사 또는 지방공사에 위탁할 수 있다.

② 시장ㆍ군수ㆍ구청장은 공사완료 보고서의 내용에 포함된 공공시설(제28조제2항에 따른 기반시설을 포함한다)을 인수하거나 관리하게 될 국가기관ㆍ지방자치단체 또는 공공기관의 장 등에게 준공검사에 참여할 것을 요청할 수 있다. 이 경우 기관ㆍ단체의 장은 특별한 사유가 없으면 요청에 따라야 한다.

③ 시장ㆍ군수ㆍ구청장은 준공검사를 한 결과 공공지원민간임대주택사업이 실시계획대로 끝났다고 인정되면 시행자에게 준공검사 증명서를 내어주고 공사 완료 공고를 하여야 하며, 실시계획대로 끝나지 아니하였으면 지체 없이 보완 시공 등 필요한 조치를 하도록 명하여야 한다.

④ 시행자가 준공검사를 받은 경우에는 제29조에 따라 의제되는 인ㆍ허가등에 따른 해당 사업의 준공검사 또는 준공인가를 받은 것으로 본다.

⑤ 제1항부터 제4항까지에서 규정한 사항 외에 공사완료 공고, 준공검사 신청 절차 등 준공검사에 필요한 사항은 국토교통부령으로 정한다.
