문화유산의 보존 및 활용에 관한 법률 제44조(정기조사)

① 국가유산청장은 국가지정문화유산의 현상, 관리, 그 밖의 보존상황 등에 관하여 정기적으로 조사하여야 한다. <개정 2015.3.27, 2023.8.8, 2024.2.13>

② 국가유산청장은 제1항에 따른 정기조사 후 보다 깊이 있는 조사가 필요하다고 인정하면 그 소속 공무원에게 해당 국가지정문화유산에 대하여 재조사하게 할 수 있다. <개정 2023.8.8, 2024.2.13>

③ 제1항과 제2항에 따라 조사하는 경우에는 미리 그 문화유산의 소유자, 관리자, 관리단체에 대하여 그 뜻을 알려야 한다. 다만, 긴급한 경우에는 사후에 그 취지를 알릴 수 있다. <개정 2015.3.27, 2023.8.8>

④ 제1항과 제2항에 따라 조사를 하는 공무원은 소유자, 관리자, 관리단체에 문화유산의 공개, 현황자료의 제출, 문화유산 소재장소 출입 등 조사에 필요한 범위에서 협조를 요구할 수 있으며, 그 문화유산의 현상을 훼손하지 아니하는 범위에서 측량, 발굴, 장애물의 제거, 그 밖에 조사에 필요한 행위를 할 수 있다. 다만, 해 뜨기 전이나 해 진 뒤에는 소유자, 관리자, 관리단체의 동의를 받아야 한다. <개정 2015.3.27, 2023.8.8>

⑤ 제4항에 따라 조사를 하는 공무원은 그 권한을 표시하는 증표를 지니고 이를 관계인에게 내보여야 한다.

⑥ 국가유산청장은 제1항과 제2항에 따른 정기조사와 재조사의 전부 또는 일부를 대통령령으로 정하는 바에 따라 지방자치단체에 위임하거나 전문기관 또는 단체에 위탁할 수 있다. <개정 2024.2.13>

⑦ 국가유산청장은 제1항 및 제2항에 따른 정기조사ㆍ재조사의 결과를 다음 각 호의 국가지정문화유산의 관리에 반영하여야 한다. <개정 2023.8.8, 2024.2.13>
