Enforcement Decree of the Act on the Protection and Utilization of Cultural Heritage, Article 47 (Designation of Historic Sites within Natural Park Areas)
① 법 제87조제1항 및 제2항에 따라 해당 공원관리청과 협의하여야 할 경우는 다음과 같다. <개정 2014.12.23, 2024.5.7>
(1) Cases requiring consultation with the relevant park management authority under Article 87 (1) and (2) of the Act are as follows:
1. 법 제87조제1항제1호 및 제2호의 경우: 「자연공원법」에 따른 공원구역에서 면적 3만 제곱미터 이상의 지역 또는 구역을 지정하는 경우
1. In the case of Article 87 (1) 1 and 2 of the Act: where an area or zone of 30,000 square meters or more is designated within a park area under the Natural Parks Act;
2. 법 제87조제1항제3호 및 같은 조 제2항의 경우: 「자연공원법」에 따른 공원구역에서 법 제35조제1항에 따라 허가나 변경허가를 하는 경우[「자연공원법」 제23조제1항 각 호의 경우로 한정하되, 국가지정문화유산, 시ㆍ도지정문화유산, 문화유산자료 또는 그 보호물의 증축, 개축, 재축(再築), 이축과 외부를 도색하는 행위는 제외한다]
2. In the case of Article 87 (1) 3 and (2) of the Act: where permission or permission for change is granted under Article 35 (1) of the Act within a park area under the Natural Parks Act [limited to the cases of each subparagraph of Article 23 (1) of the Natural Parks Act, but excluding extension, rebuilding, reconstruction, relocation, and exterior painting of nationally designated cultural heritage, Si/Do-designated cultural heritage, cultural heritage materials, or their protected objects].
② 국가유산청장은 「자연공원법」에 따른 공원구역 안에서 법 제87조제1항제1호 및 제2호에 해당하는 행위를 하는 경우로서 3만 제곱미터 미만의 지역 또는 구역을 지정하는 경우에는 해당 공원관리청에 그 내용을 알려야 한다. <개정 2024.5.7>
(2) Where an act falling under Article 87 (1) 1 and 2 of the Act is carried out within a park area under the Natural Parks Act and an area or zone of less than 30,000 square meters is designated, the Administrator of the Korea Heritage Service shall notify the relevant park management authority of the details.
