① 법 제26조제1항 단서에서 "대통령령으로 정하는 법인"이란 다음 각 호의 어느 하나에 해당하는 법인을 말한다.

나. 현지보존토지가 법 제26조제1항에 따라 매입될 경우 다음의 어느 하나에 해당하는 토지일 것

1) 면적이 너무 작거나 부정형(不定形) 등의 사유로 건축물을 건축할 수 없거나 건축물의 건축이 현저히 곤란한 대지
