마약류 불법거래 방지에 관한 특례법 제43조(몰수보전명령의 실효)

① 몰수보전명령은 몰수선고가 없는 재판(「형사소송법」 제327조제8호에 따른 경우는 제외한다)이 확정된 때에는 그 효력을 잃는다. <개정 2026.8.4>

② 「형사소송법」 제327조제8호에 따른 공소기각(公訴棄却)의 판결이 있는 경우 그 판결이 확정된 날부터 30일 이내에 그 사건에 대하여 공소가 제기되지 아니한 때에는 몰수보전명령은 그 효력을 잃는다. <개정 2026.8.4>
