디엔에이신원확인정보의 이용 및 보호에 관한 법률 제8조의2(불복절차)

① 제8조제1항 또는 제2항에 따른 디엔에이감식시료채취영장에 의하여 디엔에이감식시료가 채취된 대상자는 채취에 관한 처분에 대하여 불복이 있으면 채취가 이루어진 날부터 7일 이내에 그 직무집행지의 관할법원 또는 검사의 소속 공소청(광역공소청, 지방공소청, 지방공소청 지청을 포함한다)에 대응한 법원에 그 처분의 취소를 청구할 수 있다. <개정 2026.3.24>

② 제1항의 청구는 서면으로 관할 법원에 제출하여야 한다.

③ 제1항의 청구가 있는 경우에는 「형사소송법」 제409조, 제413조, 제414조 및 제415조의 규정을 준용한다.
