Enforcement Decree of the Act on the Management of Zoos and Aquariums, Article 14 (Standards for Fair Performance of Duties by Inspectors)
① 검사관은 다음 각 호의 어느 하나에 해당하는 경우에는 해당 동물원 또는 수족관을 대상으로 하는 검사관 업무를 수행할 수 없다.
(1) An inspector may not perform inspector duties for a zoo or aquarium in any of the following cases:
1. 검사관과 「민법」 제777조에 따른 친족이거나 친족이었던 사람이 검사관 업무의 대상인 동물원 또는 수족관에 임원 또는 직원으로 재직하고 있는 경우
1. Where a person who is or was a relative of the inspector under Article 777 of the Civil Act serves as an officer or employee of the zoo or aquarium subject to the inspector's duties;
2. 검사관 또는 그 배우자나 배우자였던 사람이 최근 3년 이내 검사관 업무의 대상인 동물원 또는 수족관에 임원 또는 직원으로 재직한 경우
2. Where the inspector or his or her spouse or former spouse has served as an officer or employee of the zoo or aquarium subject to the inspector's duties within the most recent three years;
3. 검사관 또는 그 배우자나 배우자였던 사람이 검사관 업무의 대상인 동물원 또는 수족관과 이해관계에 있는 경우
3. Where the inspector or his or her spouse or former spouse has an interest in the zoo or aquarium subject to the inspector's duties.
② 동물원 또는 수족관을 운영하는 자는 검사관에게 제1항 각 호의 어느 하나에 해당하는 사유가 있거나 검사관 업무의 공정한 수행을 기대하기 어려운 사정이 있는 경우에는 허가권자에게 해당 검사관의 배제를 요청할 수 있다. 이 경우 배제 요청의 대상인 검사관은 그 검사관 업무에 참여하지 못한다.
(2) A person who operates a zoo or aquarium may request the permitting authority to exclude an inspector where the inspector falls under any subparagraph of paragraph (1) or there are circumstances making it difficult to expect fair performance of inspector duties. In such cases, the inspector subject to the request for exclusion may not participate in the inspector duties.
③ 검사관이 제1항 또는 제2항에 해당하는 경우에는 스스로 해당 동물원 또는 수족관을 대상으로 하는 검사관 업무에서 회피해야 한다.
(3) An inspector who falls under paragraph (1) or (2) shall recuse himself or herself from inspector duties for the relevant zoo or aquarium.
