Enforcement Decree of the Act on the Improvement of Urban Areas and Residential Environments, Article 24 (Methods of Contracting and Selection of Constructors)
① 법 제29조제1항 단서에서 "계약규모, 재난의 발생 등 대통령령으로 정하는 경우"란 다음 각 호의 구분에 따른 경우를 말한다.
(1) "Cases prescribed by Presidential Decree, such as the size of the contract or the occurrence of a disaster" in the proviso to Article 29 (1) of the Act means the following cases, according to the classification below:
1. 입찰 참가자를 지명(指名)하여 경쟁에 부치려는 경우: 다음 각 목의 어느 하나에 해당하여야 한다.
1. Where bidders are to be nominated and put to competition: the case shall fall under any of the following items:
가. 계약의 성질 또는 목적에 비추어 특수한 설비ㆍ기술ㆍ자재ㆍ물품 또는 실적이 있는 자가 아니면 계약의 목적을 달성하기 곤란한 경우로서 입찰대상자가 10인 이내인 경우
(a) Where, in light of the nature or purpose of the contract, it would be difficult to achieve the purpose of the contract unless the contractor has special equipment, technology, materials, goods, or a track record, and there are no more than 10 eligible bidders;
나. 「건설산업기본법」에 따른 건설공사(전문공사를 제외한다. 이하 이 조에서 같다)로서 추정가격이 3억원 이하인 공사인 경우
(b) Construction work under the Framework Act on the Construction Industry (excluding specialized construction work; the same shall apply hereinafter in this Article) with an estimated price of 300 million won or less;
다. 「건설산업기본법」에 따른 전문공사로서 추정가격이 1억원 이하인 공사인 경우
(c) Specialized construction work under the Framework Act on the Construction Industry with an estimated price of 100 million won or less;
라. 공사관련 법령(「건설산업기본법」은 제외한다)에 따른 공사로서 추정가격이 1억원 이하인 공사인 경우
(d) Construction work under construction-related statutes (excluding the Framework Act on the Construction Industry) with an estimated price of 100 million won or less;
마. 추정가격 1억원 이하의 물품 제조ㆍ구매, 용역, 그 밖의 계약인 경우
(e) Contracts for the manufacture or purchase of goods, services, or other matters with an estimated price of 100 million won or less;
2. 수의계약을 하려는 경우: 다음 각 목의 어느 하나에 해당하여야 한다.
2. Where a private contract is to be made: the case shall fall under any of the following items:
가. 「건설산업기본법」에 따른 건설공사로서 추정가격이 2억원 이하인 공사인 경우
(a) Construction work under the Framework Act on the Construction Industry with an estimated price of 200 million won or less;
나. 「건설산업기본법」에 따른 전문공사로서 추정가격이 1억원 이하인 공사인 경우
(b) Specialized construction work under the Framework Act on the Construction Industry with an estimated price of 100 million won or less;
다. 공사관련 법령(「건설산업기본법」은 제외한다)에 따른 공사로서 추정가격이 8천만원 이하인 공사인 경우
(c) Construction work under construction-related statutes (excluding the Framework Act on the Construction Industry) with an estimated price of 80 million won or less;
라. 추정가격 5천만원 이하인 물품의 제조ㆍ구매, 용역, 그 밖의 계약인 경우
(d) Contracts for the manufacture or purchase of goods, services, or other matters with an estimated price of 50 million won or less;
마. 소송, 재난복구 등 예측하지 못한 긴급한 상황에 대응하기 위하여 경쟁에 부칠 여유가 없는 경우
(e) Where there is no time to put the contract to competition because of the need to respond to an unforeseen emergency, such as a lawsuit or disaster recovery;
바. 일반경쟁입찰이 입찰자가 없거나 단독 응찰의 사유로 2회 이상 유찰된 경우
(f) Where open competitive bidding has failed two or more times because there were no bidders or only one bidder.
② 법 제29조제2항에서 "대통령령으로 정하는 규모를 초과하는 계약"이란 다음 각 호의 어느 하나에 해당하는 계약을 말한다.
(2) "A contract exceeding the size prescribed by Presidential Decree" in Article 29 (2) of the Act means any of the following contracts:
1. 「건설산업기본법」에 따른 건설공사로서 추정가격이 6억원을 초과하는 공사의 계약
1. A contract for construction work under the Framework Act on the Construction Industry with an estimated price exceeding 600 million won;
2. 「건설산업기본법」에 따른 전문공사로서 추정가격이 2억원을 초과하는 공사의 계약
2. A contract for specialized construction work under the Framework Act on the Construction Industry with an estimated price exceeding 200 million won;
3. 공사관련 법령(「건설산업기본법」은 제외한다)에 따른 공사로서 추정가격이 2억원을 초과하는 공사의 계약
3. A contract for construction work under construction-related statutes (excluding the Framework Act on the Construction Industry) with an estimated price exceeding 200 million won;
4. 추정가격 2억원을 초과하는 물품 제조ㆍ구매, 용역, 그 밖의 계약
4. A contract for the manufacture or purchase of goods, services, or other matters with an estimated price exceeding 200 million won.
③ 법 제29조제4항 단서에서 "대통령령으로 정하는 규모 이하의 정비사업"이란 조합원이 100인 이하인 정비사업을 말한다.
(3) "An improvement project of a size not exceeding that prescribed by Presidential Decree" in the proviso to Article 29 (4) of the Act means an improvement project with 100 or fewer association members.
④ 법 제29조제7항에서 "대통령령으로 정하는 경쟁입찰"이란 다음 각 호의 요건을 모두 갖춘 입찰방법을 말한다. <개정 2024.12.17>
(4) "Competitive bidding prescribed by Presidential Decree" in Article 29 (7) of the Act means a bidding method that meets all of the following requirements:
1. 일반경쟁입찰ㆍ제한경쟁입찰 또는 지명경쟁입찰 중 하나일 것
1. It shall be one of open competitive bidding, restricted competitive bidding, or nominated competitive bidding;
2. 해당 지역에서 발간되는 일간신문에 1회 이상 제1호의 입찰을 위한 공고를 하고, 입찰 참가자를 대상으로 현장 설명회를 개최할 것
2. A public notice for the bidding under subparagraph 1 shall be published at least once in a daily newspaper published in the relevant area, and an on-site briefing shall be held for bidders;
3. 해당 지역 주민을 대상으로 합동설명회를 개최할 것
3. A joint briefing session shall be held for residents of the relevant area;
4. 토지등소유자를 대상으로 제출된 입찰서에 대한 투표를 실시하고 그 결과를 반영할 것
4. A vote of the owners of land, etc. shall be held on the submitted bids, and its results shall be reflected.
